The Constitution of Ecuador of 1861 was the seventh Ecuadorian constitution and was in force from 1861 to 1869 . It was promulgated by President Gabriel García Moreno and consists of five titles that address issues such as the Republic of Ecuador and Ecuadorians, citizens, the religion of the Republic, the Government of Ecuador, elections and the Legislative Power. The Constitution of 1861 was replaced by the Constitution of 1869, which was proposed by the president himself.

The National Convention of Ecuador has come to decree and decrees the following Constitution of the Republic.

Title I. Of the Republic of Ecuador and Ecuadorians

Section I. From the Republic
Article 1. The Republic of Ecuador is composed of all Ecuadorians gathered under the same pact of political association. Its territory includes that of the provinces that formed the former Presidency of Quito and the Galapagos archipelago. The limits shall be definitively fixed by treaties to be concluded with the neighbouring States.
Article 2. Sovereignty resides essentially in the people, and they delegate its exercise to the authorities established by the Constitution. The Republic is one, indivisible, free and independent of all foreign power, and cannot be the patrimony of any family or person.

Section II. Of Ecuadorians, their duties and political rights
Article 3. Ecuadorians are Ecuadorians by birth or by naturalization.
Article 4. Ecuadorians by birth:
1. Those born in the territory of Ecuador;
2. Those born in another country of Ecuadorian father or mother by birth, provided that they come to reside in the Republic.
Article 5. Ecuadorians by naturalization are:
1. Nationals of other States who are currently enjoying this right;
2. Foreigners who profess any science, art or useful industry, or who are owners of any real estate or capital in turn and, after one year of residence, declare before the authority designated by law their intention to settle in Ecuador;
3. Those who obtain from Congress a letter of nature for services they have rendered or may render to the country; or the Executive Power in cases prevented by law.
